LIVERMORE – A pre-trial hearing is set for 8:30 a.m. Nov. 3 for a shoreland zoning violation at Long Pond.

The case is the second alleged violation of shoreland zoning by Jose Diaz. The first was in July 2002, when Diaz was fined $500 and ordered not to cut any wood vegetation.

Code Enforcement Officer Richard Marble reported a second alleged violation, and in September 2003 the Board of Selectpersons assessed a $2,500 fine. Diaz took the issue to the Appeals Board on Nov. 18, 2003, and the appeal was denied.

Marble has found two other violations on Long Pond, both in the Waters Hill Estates sub-division. One owner, Michael Saucier of Winthrop, has built a road to the shore and has until Oct. 30 to pay the $750 fine.

The second owner, Timothy Chouinard of Greene, has placed wood chips, a fireplace and picnic area in the buffer area, all of which are in violation. The board felt a similar fine was in order.

In another court case, Jennifer Hart was ordered to erect two kennels for her dogs by June 1. That was not done, and photos have been submitted as evidence. The town is seeking reimbursement for legal fees.

Administrator Kurt Schaub reported a $4,096 refund from Franklin Memorial Hospital on the ambulance subsidy. He explained that the hospital would like to operate under a single contract with all participating towns, offering a uniform subsidy formula that has not yet been developed.
