HOPKINTON, Mass. (AP) – A Falmouth Clerk Magistrate rules that there is sufficient evidence to charge Hopkinton’s town manager with motor vehicle homicide stemming from a head-on collision on Cape Cod.

Anthony Troiano of Sandwich was trying to pass another vehicle while driving on Sandwich Road in Bourne on May 15th when he collided with a car driven by 69-year-old Lilija Berents of Falmouth.

Berents was thrown from the car and pronounced dead at the scene. The 51-year-old Troiano suffered a broken femur, torn aorta and collapsed lungs.

Clerk Magistrate Edward Teague says there is enough evidence to charge him with motor vehicle homicide by negligent operation. He also faces charges of failure to pass safely, speeding and a marked lanes violation.

Troiano’s lawyer, Augustus Wagner, declined immediate comment.
