AUBURN — A former clerk at Livermore Falls Sewer District who was jailed for embezzling more than $100,000 from the department is due back in court Wednesday.
Faith Nichols, 40, of 154 Fayette Road, Livermore Falls is accused of failing to pay restitution and supervisory fees. Prosecutors filed a motion to revoke her probation. A hearing is scheduled for Wednesday at Androscoggin County Superior Court.
Through a plea negotiation, Nichols was convicted of theft by unauthorized taking or transfer, a felony, for stealing $102,000 from the town’s Sewer Department over 18 months. She was sentenced to six years in prison, with all but two months suspended. She also was sentenced to four years probation.
According to court papers, Nichols has paid only $871 of $46,000 restitution ordered by the court. She also has failed to pay $15 per month for supervision fees to the Maine Department of Corrections and still owes $670, according to a motion filed with the court.
She had repaid the town $25,000, her attorney said following her court arraignment.
Nichols had admitted to police and town selectmen that she had taken the money. She had also apologized to the town through her lawyer and had vowed to pay the money back.
Nichols apparently stole the money over 18 months, mostly during a nine-month period, according to auditors. Nichols resigned as sewer clerk in November 2005, citing health and personal reasons.
Auditors from RHR Smith & Co. informed selectmen in late 2005 that there appeared to be problems in the town’s sewer account.
The town placed a lien on Nichols’ house, which has since been sold, and $31,843.26 of the proceeds have been transferred to the town toward the reimbursement.
