FARMINGTON, Maine (AP) — A federal court has ruled that a jury will decide a lawsuit brought by two former inmates at the Franklin County jail who claim guards contaminated their food as a prank.

After dismissing certain aspects of the lawsuit this summer, U.S. Magistrate Judge Margaret Kravchuk scheduled jury selection and the trial for Monday, Nov. 14, in U.S. District Court in Bangor.

An attorney for Robert Ayer of New Sharon and Stephen Wing of Industry alleges the female corrections officers in 2008 contaminated veal patties and spaghetti with pepper spray, Mace or some other noxious chemical and then laughed at the inmates when they became sick.

Attorney Jonathan Hull tells the Kennebec Journal that the guards claimed they used hot mustard from a Chinese restaurant.
