JAY — A local man who pleaded guilty to a federal charge of embezzlement in April faces an unrelated charge of theft from the state.

On Thursday, a Franklin County grand jury indicted Timothy P. Gallagher, 47, of Jay on the felony charge of theft by deception from the Maine Department of Labor between April 11, 2015, and May 30, 2015, according to an indictment.

A conviction is punishable by a maximum of five years in prison and/or a $5,000 fine.

Julie D. Rabinowitz, director of policy, operations and communications for the Department of Labor, said Monday that she could not comment on the case. Unless a case is presented in open court, confidentiality rules prohibit the department from disclosing particular information, she said.

Gallagher, a former construction manager for Stanford Management, pleaded guilty in April in U.S. District Court in Portland to embezzling nearly $80,000 from a program that receives federal funds. He is scheduled to be sentenced in August in that matter, according to court documents.

A conviction on the charge carries up to 10 years in prison and a fine of up to $250,000.
