LIVERMORE FALLS — Police said a Jay man is accused of swearing and yelling at a Cumberland Farms clerk Monday night after he refused to sell him beer.
Officer Troy Reed tried to calm things down but Gary Voter, 57, kept swearing and yelling at the clerk. Reed ordered him to stop and leave the property but he refused, Police Chief Ernest Steward Jr. said.
Reed arrested Voter, who continued to yell and swear in the direction of the clerk. Voter was about 3 inches from the officer’s face and was still swearing and yelling at the clerk, Steward said.
Voter and Reed scuffled and Voter had to be forcibly restrained, Steward said. Voter tried unsuccessfully to put the officer’s head down so he could knee him, he said.
Androscoggin County Sgt. Tim Kachnovich assisted Reed at the 9:35 p.m. incident at the Main Street store.
Reed charged Voter with refusing to submit to arrest or detention — physical force, and disorderly conduct.
A conviction on the refusing to submit charge is punishable by a maximum 364 days and a $2,000 fine.
Voter was being held on $200 cash bail at the Androscoggin County Jail in Auburn as of midmorning Tuesday.
He is scheduled to appear at a Lewiston court on Dec. 14.
