FARMINGTON — A Jay man pleaded guilty Tuesday to loading a shotgun and threatening a neighbor in August before going outside a Crash Road apartment and shooting off a round.
Tristan R. Franchetti, 25, pleaded guilty to misdemeanor charges of threatening display of a weapon and terrorizing, according to court documents.
The state dismissed a felony charge of criminal threatening with a dangerous weapon.
A conviction on each of the misdemeanor charges is punishable by a maximum of 364 days in jail and a $2,000 fine.
Sentencing was delayed for 12 months to allow Franchetti to complete several tasks outlined in a deferred disposition agreement. Among the conditions are no use or possession of alcohol and being subject to random searches. He is also prohibited from having firearms at his residence.
Franchetti is required to forfeit a Remington shotgun, according to court documents.
Jay police and other law enforcement agencies responded to a complaint at about 1 a.m. on Aug. 13 of an intoxicated man outside a residence on Crash Road firing a shotgun, according to an affidavit filed with the court.
Police made contact with Franchetti and found a shotgun shell on the ground outside his residence. He acknowledged that he fired the shotgun outdoors. A loaded firearm was seized from the doorway of the residence, according to Jay police.
“Tristan was observed by officers to be heavily intoxicated,” Jay Detective Michael Mejia wrote. “Further investigation revealed that he had become angry during an argument and took possession of the firearm inside the home. He chambered a round into the shotgun and began making threats to another individual about firing it just prior to going outside and doing so.”
